Website Terms of Use

These Terms of Use govern your access to and use of the fornida.com website. They are separate from the agreements that govern Fornida's paid services.

1. Acceptance of These Terms

By accessing or using the website at fornida.com(the “Site”), you agree to these Website Terms of Use and to our Privacy Policy. If you do not agree, do not use the Site.

2. Relationship to Service Agreements

These Terms of Use govern the Site only. Fornida’s managed and hosted services are governed by separate contracts, including the Master Services Agreement, the Managed IT Services Terms, the Hosted Cloud Terms, and the Hosted Cloud SLA. In the event of a conflict between these Terms of Use and a signed services agreement regarding the services, the signed services agreement controls.

3. Permitted Use

Fornida grants you a limited, revocable, non-exclusive license to access and use the Site for lawful, informational, and business-evaluation purposes. You agree not to:

  1. Use the Site in violation of any applicable law or regulation.
  2. Attempt to gain unauthorized access to the Site, its servers, or any connected systems or networks.
  3. Probe, scan, or test the vulnerability of the Site, or breach security or authentication measures, without authorization.
  4. Interfere with or disrupt the Site, including by transmitting malware, launching denial-of-service activity, or generating excessive automated traffic.
  5. Scrape, harvest, or collect information about other users, or use the contact forms to transmit spam or unsolicited communications.
  6. Reproduce, distribute, or create derivative works from Site content except as permitted in Section 4.

4. Intellectual Property

The Site and its content — including text, graphics, logos, the Fornida name and marks, design, and software — are owned by Fornida, LLC or its licensors and are protected by intellectual-property laws. You may view and print content for your own internal, non-commercial reference. All other rights are reserved. Trademarks and product names of third parties are the property of their respective owners.

5. Hardware Shop and Third-Party Services

The hardware shop, cart, and checkout are provided through a third-party storefront and payment providers. Purchases made through the shop are subject to the terms, pricing, and policies presented at checkout. The Site may also contain links to third-party websites and services; Fornida does not control and is not responsible for their content, practices, or terms.

6. Disclaimers

The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Fornida does not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Information on the Site is general in nature and is not professional, legal, or security advice.

7. Limitation of Liability

To the fullest extent permitted by law, Fornida and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Site, even if advised of the possibility of such damages. Fornida’s total liability arising from or related to the Site or any claim will not exceed the amount, if any, you actually paid to Fornida for the product or service giving rise to the claim. Where no amount was paid, Fornida will have no liability.

8. Indemnification

You agree to indemnify and hold harmless Fornida, LLC and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms of Use or applicable law.

9. Governing Law

These Terms of Use are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any dispute relating to the Site lies in the state or federal courts located in Collin County, Texas, and you consent to their jurisdiction.

10. Changes

Fornida may modify these Terms of Use at any time by updating this page and the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
